3. Personal information we may collect

Depending on your relationship with us, we may collect information such as your name, email address, telephone number, communications with us and other information necessary to provide or administer our services.

For students and parents/carers, this may also include the student's age or school year, educational level, tuition requirements, availability, lesson arrangements, attendance, lesson reports, progress, homework, learning goals, invoice/payment information and other information relevant to providing tuition.

Parents or students may sometimes provide information relating to learning needs, SEND, health or personal circumstances. We aim only to collect this information where it is relevant and appropriate for tuition or safeguarding.

For tutor applicants and tutors, information may include contact details, application information, CV and employment/education history, qualifications, experience, subjects and levels taught, availability, expected or agreed rates, interview and teaching-demo information, references, referee details, identity and vetting information, safeguarding-training information, DBS-related information where appropriate and lawful, insurance information where required, payment information and records relating to the tutor's work with the business.

Safeguarding and complaint records may contain additional information relevant to the particular concern.

4. How we collect personal information

We may collect information through our Wix website and online forms, email, telephone, WhatsApp, consultations, tutor applications, interviews, references, lesson delivery and administration, Google Calendar, accounting and invoicing systems, and communications with parents, students and tutors.

We may also receive information from other people or organisations, such as parents/carers, referees or safeguarding bodies where appropriate.

5. Why we use personal information

We may use personal information to respond to enquiries; arrange consultations; assess tuition requirements; provide and administer tuition; schedule lessons; communicate with parents, students and tutors; monitor student progress; provide lesson reports; manage payments and invoices; recruit and vet tutors; obtain references; carry out safer-recruitment processes; manage tutor arrangements; handle complaints; fulfil safeguarding responsibilities; maintain security and business records; comply with legal obligations; establish or defend legal rights; and operate and improve the business.

We may also use website information, subject to applicable consent requirements, to understand how our website is used and to measure and improve our advertising.

6. Lawful bases for using personal information

The lawful basis depends on the particular purpose for which information is being used.

Depending on the circumstances, we may process personal information because:

  • it is necessary to take steps before entering into a contract or to perform a contract;

  • we have a legal obligation;

  • it is necessary for our legitimate interests or those of another person, where those interests are not overridden by the individual's rights;

  • consent has been provided where consent is the appropriate basis; or

  • another lawful basis applies.

Our legitimate interests may include operating and administering the tuition business, maintaining appropriate records, protecting the business and its users, responding to enquiries and improving our services.

Where we process special-category information or criminal-offence information, we will also identify an appropriate additional legal condition where required.

The ICO requires organisations to identify and communicate the lawful basis used for their processing.

7. Children's information

A significant part of our service involves children and young people, so we recognise that their personal information requires particular care.

We aim to collect only information reasonably necessary for tuition, administration or safeguarding; restrict access to people who genuinely need it; maintain appropriate security; and take particular care with sensitive and safeguarding information.

Parents or carers will normally provide or facilitate the information necessary to arrange tuition for a child.

8. Safeguarding information

Where a safeguarding concern arises, relevant information may be recorded and used where necessary to protect a child or another person, assess or respond to a concern, obtain safeguarding advice, make an appropriate referral, cooperate with relevant authorities or comply with applicable obligations.

Safeguarding information will be subject to restricted access and should not be treated as ordinary lesson information.

Information may need to be shared without consent where this is necessary and lawful to protect a child or another person.

9. Tutor recruitment and vetting

Information collected during tutor recruitment may be used to assess applications, shortlist candidates, conduct interviews and teaching demonstrations, verify experience and qualifications, obtain references, carry out safeguarding and safer-recruitment processes, undertake appropriate DBS/vetting processes and assess suitability to provide tuition.

Information about referees will be used for obtaining and maintaining appropriate recruitment references.

10. Who we may share information with

We do not sell personal information.

Where necessary and lawful, information may be shared with tutors who need appropriate student information to provide tuition; website and technology providers; email, cloud-storage and communication providers; accounting and invoicing providers; payment providers; professional advisers; insurers; safeguarding organisations or authorities; regulators or law-enforcement bodies; and other organisations where disclosure is necessary and lawful.

Tutors should only receive information reasonably necessary for the students or activities for which they are responsible.

11. Systems and service providers

Systems and providers currently used or potentially used by the business include:

  • Wix;

  • Google services, including Gmail, Calendar, Meet, Google Analytics, Google Tag and Google Ads;

  • Wix Analytics;

  • Microsoft and OneDrive;

  • WhatsApp;

  • ZipBooks;

  • banking and payment services; and

  • other appropriate business software.

We have removed Microsoft Clarity from our website and do not currently use it.

12. Website analytics and advertising

We use Wix Analytics and Google Analytics to understand how visitors use our website and to help us improve its performance.

We also use Google Tag and Google Ads in connection with advertising and measurement. This helps us understand the effectiveness of our advertising campaigns and, where applicable, actions visitors take after interacting with our advertising.

Depending on the technologies involved and the visitor's choices, information may include pages visited, interactions with the website, how a visitor reached the website, device/browser information, approximate location or technical information, and information used for analytics or advertising measurement.

Our current Wix Google Tag configuration uses basic consent mode. Based on the configuration we checked, Google-related data is only sent where the relevant visitor consent has been provided.

Analytics and advertising technologies that require consent are treated as optional rather than essential.

The ICO states that storage/access technologies used for online advertising and advertising measurement require consent, and non-essential cookies should not be set before valid consent is obtained.

13. Cookies and consent

Our website uses cookies and similar technologies.

Some are essential to the operation, security and functionality of the website and may operate without consent where an applicable exemption permits this.

Other technologies, including analytics and advertising technologies, are optional and require consent where applicable.

We use Usercentrics for Wix to manage cookie and tracking preferences.

Visitors can:

  • Accept All optional technologies;

  • Deny optional technologies; or

  • open Settings to manage their preferences.

Visitors can also change or withdraw their choices using the cookie/privacy settings available through the website.

The ICO says websites must tell users what cookies do and why and obtain consent for non-essential cookies; users must also have meaningful control over them.

14. International data transfers

Some of the technology providers we use may process or store information outside the United Kingdom.

Where UK data-protection law requires safeguards for an international transfer, we will rely on an appropriate transfer mechanism or safeguards provided by the relevant service provider.

15. How we protect personal information

We take reasonable measures to protect personal information.

These include password-protected devices; two-factor or two-step authentication on key accounts where available; device encryption; automatic computer locking; software and operating-system updates; account-access controls; and reviews of file-sharing permissions.

Tutors will only be given access to information reasonably necessary for their work.

16. How long we keep information

We only keep personal information for as long as reasonably necessary for the purposes for which it was collected and to meet applicable legal, safeguarding, accounting, insurance and business requirements.

We maintain a Data Retention and Deletion Schedule setting out normal retention periods for different categories of information.

For example, different retention periods apply to client and student records, tutor and recruitment records, financial records, safeguarding information and website information.

Safeguarding records are treated separately from ordinary tuition records and will not be routinely deleted simply because tuition has ended.

We review retained personal information at least annually. When information is no longer required and there is no continuing reason to retain it, it will be securely deleted, destroyed or anonymised as appropriate.

17. Your data-protection rights

Depending on the circumstances and the lawful basis being used, individuals may have rights including the right to:

  • request access to their personal information;

  • ask for inaccurate information to be corrected;

  • ask for information to be erased in certain circumstances;

  • ask for processing to be restricted in certain circumstances;

  • object to certain processing;

  • receive certain information in a portable format where applicable; and

  • withdraw consent where processing relies on consent.

These rights are not absolute and depend on the circumstances.

You also have the right to object to processing based on legitimate interests in applicable circumstances.

19. Changes to this Privacy Notice

We may update this Privacy Notice when our services, systems, legal obligations or use of personal information changes.

The latest version will be made available through our website.

Where required, we will bring material new uses of existing personal information to the attention of affected individuals before beginning the new processing. This reflects the ICO's guidance that privacy information should be kept under review and updated when necessary.
